Jacobsen AR5 accident injured golf course grounds keeper

On May 24, 2005 our client was operating a large commercial mower known as a Jacobson AR5 rotary mower on the Twin Creeks Golf Course in Austin, Texas.  This mower was a demonstartion model that had been delivered for evaluation, and had never been used on the course before.    The machine began to slide sideways down a slope, and continued over an 8 foot drop.  The individual was mowing a slope had been successfully mowed on other occasions in the past with other brands of lawnmowers.  The AR5 came to rest upside down and on top of the operator, causing catastrophic personal injuries.  

The manufacturer required the machine to be equipped with a roll over protection structure, or ROPS (a device similar to a roll bar) but the owner of the machine failed to equip the machine with this device before providing it to the operator. 

The operator sustained a fractured skull, three fractured ribs, a fractured left tibia and fractures to his nose and the bones around his eyes.  He suffered from a traumatic brain injury and damage to his optic nerves that rendered him without sight.  He was in a coma for six weeks and hospitalized for a total of nine weeks.  The rehabilitation process took over one and one half years. 

The law firm of OMD filed suit in Travis County, Texas.  The case settled before trial.
